Please read these Terms and Conditions (“Terms”) carefully before using the diasporaexcel.com website (“Service”) operated by Diaspora Excel travel (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Services Offered

Diaspora Excel Travel acts as a travel agency, facilitating the booking of various travel-related services, including but not limited to:

  • Flights
  • Accommodation (hotels, resorts, villas)
  • Tours and excursions
  • Car rentals
  • Customised itinerary planning

We act as an agent for third-party suppliers (e.g., airlines, hotels, tour operators). Our role is to facilitate your booking; your contract for the travel services is directly with the respective third-party supplier.

2. User Obligations

By using our Service, you agree to:

  • Provide accurate, current, and complete information when making a booking or inquiry.
  • Ensure that all information provided for all travellers in your booking is accurate and up-to-date.
  • Use the Service only for lawful purposes and under these Terms.
  • Not to engage in any activity that interferes with or disrupts the Service or the servers and networks connected to the Service.
  • Keep your account login details secure and confidential if you create an account.

3. Booking and Payment

a. Pricing and Availability
All prices displayed on our website are subject to change without notice until a booking is confirmed. Availability of services is not guaranteed until confirmed by the respective supplier.
b. Deposits and Final Payments
Specific payment terms, including deposit amounts, due dates for final payments, and accepted payment methods, will be communicated to you at the time of booking. Failure to make payments by the specified deadlines may result in the cancellation of your booking.
c. Confirmation
A booking is not confirmed until you receive a written confirmation from Diaspora Excel Travel, which will typically include your itinerary, booking references, and payment details.

d. Cancellations and Amendments

  • Cancellation by You: Cancellation and amendment policies vary by supplier and fare type. You are responsible for understanding the cancellation and amendment terms applicable to your booking. Fees may apply for cancellations or changes, as imposed by the supplier or Diaspora Excel travel.
  • Cancellation by Supplier: In the event a supplier cancels or significantly changes your booking, we will notify you as soon as reasonably possible and assist you in finding alternative arrangements or obtaining a refund, subject to the supplier’s terms and conditions.
  • Refunds: Refunds for cancelled bookings are subject to the terms and conditions of the individual suppliers and may take time to process. Diaspora Excel travel will facilitate the refund process but is not responsible for the timing or amount of refunds from third-party suppliers.

4. Travel Documents

You are solely responsible for ensuring that you and all members of your travelling party possess valid passports, visas, health certificates, and any other travel documents required for your itinerary, including transit countries. Diaspora Excel travel can provide general advice, but does not accept liability for any loss or expense incurred due to your failure to comply with such requirements.

6. Limitation of Liability

Diaspora Excel Travel acts as an agent only. We are not liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party suppliers (e.g., airlines, hotels, tour operators) or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.
In no event shall Diaspora Excel travel, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify, and hold harmless Diaspora Excel travel and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) your violation of any rights of another.

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Diaspora Excel Travel and its licensors. The Service is protected by copyright, trademark, and other laws of both Kenya and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Diaspora Excel Travel.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed under the laws of Kenya, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by the courts of Kenya.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorised to use the Service.
